The U.S.Supreme Court's 6-decision in Gonzales v. Oregon is the latest defeat for the Bush administration in its sustained attack on Oregon's physician-assisted suicide law. Both the majority opinion and the major dissent in Oregon provide an opportunity to assess the dangers inherent in allowing a political agenda that emphasizes the sanctity of life and minimizes professional ethical obligations to overshadow quality patient care at the end of life.

Over the past decade or so, no issue in medical ethics or bioethics law has raised more concerns about federal intervention in the practice of medicine, about judicial attempts to craft health policy, or about the wisdom of public mandates directing specific health care initiatives than the issue of physician-assisted suicide. State voter referenda, lower and federal court cases, proposed legislation in both houses of Congress, and orders and determinations from agencies within the executive branch of two administrations are representative (...) of the kinds of actions taken in the last ten years implicating medical care at the end of life. Whether the intent was to codify into law physician-assisted suicide, to deny a constitutional right of assisted suicide, or to make “easier” physicians' efforts to alleviate intractable suffering at the risk of hastening death, or to prohibit physician aid in dying altogether, the impact on the patient-doctor relationship and on our understanding of what constitutes dignified and humane care at the end of life is undeniable. Philosophers often find themselves in disagreement with contemporary philosophers they know full well to be their epistemic superiors on the topics relevant to the disagreement. This looks epistemically irresponsible. I offer a detailed investigation of this problem of the reflective epistemic renegade. I argue that although in some cases the renegade is not epistemically blameworthy, and the renegade situation is significantly less common than most would think, in a troublesome number of cases in which the situation arises the renegade is (...) blameworthy in her disagreement with recognized epistemic superiors. I also offer some thoughts on what it would mean for philosophical practice for us to refrain from being renegades. Finally, I show how a new kind of radical skepticism emerges from modest theses regarding the renegade. (shrink)

I’m going to argue for a set of restricted skeptical results: roughly put, we don’t know that fire engines are red, we don’t know that we sometimes have pains in our lower backs, we don’t know that John Rawls was kind, and we don’t even know that we believe any of those truths. However, people unfamiliar with philosophy and cognitive science do know all those things. The skeptical argument is traditional in form: here’s a skeptical hypothesis; you can’t epistemically neutralize (...) it, you have to be able to neutralize it to know P; so you don’t know P. But the skeptical hypotheses I plug into it are “real, live” scientific-philosophical hypotheses often thought to be actually true, unlike any of the outrageous traditional skeptical hypotheses (e.g., ‘You’re a brain in a vat’). So I call the resulting skepticism Live Skepticism. Notably, the Live Skeptic’s argument goes through even if we adopt the clever anti-skeptical fixes thought up in recent years such as reliabilism, relevant alternatives theory, contextualism, and the rejection of epistemic closure. Furthermore, the scope of Live Skepticism is bizarre: although we don’t know the simple facts noted above, many of us do know that there are black holes and other amazing facts. (shrink)

Suppose you know that someone is your epistemic peer regarding some topic. You admit that you cannot think of any relevant epistemic advantage you have over her when it comes to that topic; you admit that she is just as likely as you to get P's truth-value right. Alternatively, you might know that she is your epistemic superior regarding the topic. And then after learning this about her you find out that she disagrees with you about P. In those situations (...) it appears that the confidence with which one holds one's belief should be significantly reduced. My primary goal in this essay is to present and reflect upon a set of cases of disagreement that have not been discussed in the literature but are vital to consider. I argue that in the new cases one is reasonable in not lowering one?s confidence in the belief. Then I articulate and defend an ambitious principle, the Disagreement Principle, meant to answer the question 'Under what conditions am I epistemically blameworthy in retaining my belief with the same level of confidence after I have discovered recognized peers or superiors who disagree with me?'. This dissertation is an investigation of the philosophic psychology of Mengzi , a Chinese Confucian of the 4th century B.C. As such, it is concerned with the role of desires, emotions, and practical reasoning in Mengzi's conception of self-cultivation and ethical flourishing. In chapter 1, I discuss why Mengzi is still worth studying by philosophers, certain hermeneutic issues, and the historical factors that account for some of the characteristic differences between Chinese and Western philosophy. ;In chapter 2, I proceed to (...) problems of philosophic psychology, examining Mengzi's views on desire and its role in both the perfected and developing moral agent. I also contrast Mengzi's attitude toward the role of desires with that of Xunzi in order to bring out what is distinctive of both views. ;Chapter 3 discusses the role of practical reasoning in the Mengzi. I first critique one important interpretation of the role of practical reasoning in the Mengzi--that of Kwong-loi Shun. Shun, developing some ideas implicit in the work of David S. Nivison, argues that Mengzi emphasizes analogical reasoning and consistency in ethical deliberation, but I attempt to demonstrate that the text will not support Shun's reading. I then proceed to offer my own view of Mengzian practical reasoning. I conclude that Mengzi is a sort of intuitionist, but of an interestingly different kind from classic Western intuitionists such as Sidgwick, Moore, and Prichard. ;Finally, in my appendix, I translate and comment upon some quotations which are attributed to Mengzi, but which are not found in the text of the Mengzi as it has come down to us. nnas' article is the first of three in a "Symposium on Ancient Ethics." She begins with the observation that ancient ethics are "eudaemonist" in form. That is, they assume "that each of us has a vague and unarticulated idea of an overall or final goal in our life," which we label eudaimonia or happiness, "and the task of ethical theory is to give each person a clear, articulated, and correct account of this overall goal and how to achieve it" (p. (...) 241; Annas defends this generalization, which is controversial as applied to Stoic and Epicurean ethics, in her The Morality of Happiness [Oxford, 1993]). Furthermore, whereas modern ethical theories (e.g., those of Kant and Sidgwick) typically distinguish between "moral reasoning" and "prudential reasoning," ancient ethical theories do not. How come? One "widespread" and "traditional" view (pp. 244, 245) is that ancient ethics assimilate morality to prudence: "ethical theory guides the agent from an intuitive, restrictive view of what is in her interests (money, power) to a more expanded and elevated view (the virtues)" (p. 244). This interpretation is sometimes joined with the claim that the Greeks took for granted what Nicholas White terms "fusionism": the view that individual good is not ultimately distinct from social or collective good (p. 245). However, Annas notes, ancient Greek literature provides ample illustration that "fusionism" was not taken for granted. (shrink)

Jeffrey King argues that nothing has truth conditions except by being taken to be true or false by rational agents. But – for good reason – King claims that propositions possess truth conditions essentially and intrinsically. I will argue that King cannot have both: if the truth conditions of a proposition depend on the reactions of rational agents, then the possession of truth conditions can't follow from the intrinsic nature or existence of the proposition. This leaves two options. Either, nothing (...) can do the job that motivates positing propositions. Or, there is no need to explain what bestows a truth condition on a proposition. (shrink)

Kripke’s puzzle has puts pressure on the intuitive idea that one can believe that Superman can fly without believing that Clark Kent can fly. If this idea is wrong then many theories of belief and belief ascription are built from faulty data. I argue that part of the proper analysis of Kripke’s puzzle refutes the closure principles that show up in many important arguments in epistemology, e.g., if S is rational and knows that P and that P entails Q, then (...) if she considers these two beliefs and Q, then she is in a position to know that.. Saul Kripke's puzzle about belief demonstrates the lack of soundness of the traditional argument for the Fregean fundamental principle that the sentences 'S believes that a is F' and 'S believes that b is F' can differ in truth value even if a = b. This principle is a crucial premise in the traditional Fregean argument for the existence of semantically relevant senses, individuative elements of beliefs that are sensitive to our varying conceptions of what the beliefs are about. Joseph (...) Owens has offered a new argument for this fundamental principle, one that is not subject to Kripke's criticisms. I argue that even though Owens' argument avoids Kripke's criticisms, it has other flaws. (shrink)

Since 9/11, the possibilities for pluralism and tolerance have been severely tested by a discourse of terrorism and security. The development of an intelligent and cosmopolitan understanding between religious communities in Europe and America has been compromised by a range of legal and political responses to terrorism. While the debate about the berqa has clearly indicated the problems relating to Muslim cultural differences, we argue that legal pluralism and in particular the question of Shari’a tribunals may prove to be a (...) more decisive test of Western multiculturalism. This article examines the many criticisms raised against religious arbitration in domestic affairs and considers the presence of the Shari’a at various levels of society, claiming that the evolution of Sharia-mindedness is compatible both with a faith-based life and with liberal ideals. However, the problem with religious courts lies elsewhere, namely with the fragmentation of social life and the erosion of citizenship. The article concludes by examining the prospects and problems of Turkish entry into the European Union with special reference to the domestic policies of the Justice and Development Party. (shrink)

The concept of health is not only a specific criterion for evaluation of water quality delivered by a distribution system but also a suitable paradigm for overall functioning of the hydraulic and structural components of the system. This article views health, despite its complexities, as the only criterion with suitable depth and breadth to allow a holistic assessment of system performance. Although many decisions relating to the planning and design of water distribution systems do implicitly consider human health, engineers and (...) planners seldom explicitly adopt a “health mindset” overall and, thus, miss the richness and possibilities of a health framework for a wider range of system evaluations, considerations, and trade-offs. This article argues why a breakdown in a healthy system will so frequently result in stresses experienced by humans and briefly reviews the concepts of human health and system health and provides specific examples of a significant interaction between the two. This article argues that the 2010 short film Pumzi is an exploration of post-crisis, ecological rehabilitation that asks for a rethinking of narratives modes for representing climate change. Employing seeds and sowing as ecological tropes, Pumzi explores how we create and carry narrative in relation to a rapidly changing earth. Both the multi-scalar geographical expanses as well as the deep geological timelines of Anthropocene discourse mean that placing the human in relation to its post-crisis environment requires more collective notions of (...) what narrative production and world building mean. This article argues that Pumzi cultivates a sympoietic—making together—mode of storytelling in an age of environmental crisis and planet-death as a well to both tell new stories and to think future worlds. In this way, Pumzi offers us a vision of an afrofuturist eco-ethics based in narrative practice. (shrink)

Zen Masters of Japan is the second book in a series that traces Zen's profoundly historic journey as it spread eastward from China and Japan, toward the United States. Following Zen Masters of China, this book concentrates on Zen's significant passage through Japan. More specifically, it describes the lineage of the great teachers, the Pioneers who set out to enlighten an island ready for an inner transformation based on compassionate awareness. While the existing Buddhist establishment in Japan met early Zen (...) pioneers like Dogen and Eisai with fervent resistance, Zen Buddhism ultimately perservered and continued to become further transformed in its passage through Japan. The Japanese culture and Japanese Buddhism practices further deepened and strengthened Zen training by combining it with a variety of esoteric contemplative arts--the arts of poetry, the tea ceremony, calligraphy, and archery. Zen Masters of Japan chronicles this journey, and shows how the new practices soon gained in popularity among all walks of life--from the lowly peasant, offering a hope of reincarnation and a better life; to the Samurai warrior due to its casual approach to death; to the ruling classes, challenging the intelligentsia because of its scholarly roots. A collection of Zen stories, meditation, and their wisdom, Zen Masters of Japan also explores the illusive state of 'No Mind' achieved in Japan that is so fundamental to Zen practices today. We present a geometric construction that yields completeness results for modal logics including K4, KD4, GL and GL n with respect to certain subspaces of the rational numbers. These completeness results are extended to the bimodal case with the universal modality.

Jean-Francois Lyotard is often considered to be the father of postmodernism. Here leading experts in the field of cultural and philosophical studies, including Barry Smart, John O' Neill and Victor J. Seidler, tackle many of the questions still being asked about this controversial figure.

In an effort to further explore ostensible macroscopic psychokinesis (macro-PK) effects like those previously reported by Batcheldor (1966), Bourgeois (1994), Owen and Sparrow (1976), and Ullman (2001) in a sitter group setting, the first author designed and conducted a series of fifteen experimental sessions in which sitters claiming exceptional abilities attempted to generate a pseudo-spirit named "Daniel," to whom physical phenomena were attributed. To explore possible physical correlates of macro-PK, two approaches to measurement were utilized. In the first, sample data (...) from a local random number generator (RNG) continuously running as part of the Global Consciousness Project were extracted and examined for statistical deviations from randomness occurring in conjunction with the sitter group sessions. In the second, the Multi-Energy Sensor Array (MESA) was used to collect onsite environmental data during one of the sessions. While displays of ostensible macro-PK were observed during several of the sitter group sessions, the RNG data did not show a significant overall correlation with the sessions. The MESA data indicated notable drops in infrared and visual light, as well as changes in DC magnetic field strength, that are comparable to those observed in field studies of haunts. The Professional Practice Program, also known as the co-operative education (co-op) program, at the University of Cincinnati (UC) is designed to provide eligible students with the most comprehensive and professional preparation available. Beginning with the Class of 2006, students in UC’s Centennial Co-op Class will be following a new co-op curriculum centered around a set of learning outcomes Regardless of their particular discipline, students will pursue common learning outcomes by participating in the Professional Practice Program, which will cover issues of (...) organizational culture, technology, professional ethics, and the integration of theory and practice. During their third co-op work term, students will complete a learning module on Professional Ethics. To complete the learning module students must familiarize themselves with the code of ethics for their profession, create a hypothetical scenario portraying an ethical dilemma that involves issues covered by the code, resolve the dilemma, and explain why their resolution is the best course of action based upon the code of ethics.
